GDPR: Personal Data Processing Information

In accordance with Art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), LepszeSMSy.pl informs you about the principles of processing your personal data.

Processing is carried out in accordance with applicable law, in particular the GDPR and applicable national data protection legislation.

Purpose of processing: provision of the SMS service, account management, billing, communication with the User.

Legal basis: Art. 6(1)(b) GDPR (contract), Art. 6(1)(f) GDPR (legitimate interest), Art. 6(1)(a) GDPR (consent).

Data recipients: processors acting on behalf of the Controller (hosting, payments, analytics) under data processing agreements.

Retention period: duration of the agreement plus 5 years for tax and archiving purposes.

Transfer to third countries: data may be transferred to the USA solely on the basis of standard contractual clauses approved by the European Commission.

Under the GDPR, you have the following rights:

• Right of access (Art. 15 GDPR): you may obtain information about what data we process.
• Right to rectification (Art. 16 GDPR): you may correct inaccurate or incomplete data.
• Right to erasure (Art. 17 GDPR): the right to be forgotten when data is no longer necessary.
• Right to restriction of processing (Art. 18 GDPR), in certain cases you may limit the scope of processing.
• Right to data portability (Art. 20 GDPR): you may receive your data in a structured format.
• Right to object (Art. 21 GDPR): you may object to processing based on legitimate interest.
• Right to withdraw consent: if processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
