These Terms apply to both Service Provider brands: AwesomeSMS (awesomesms.com) and LepszeSMSy.pl (lepszesmsy.pl). Features, pricing and policies are identical, only visual layer and default language differ.
1.1 Service: the SMS management and scheduling platform available at LepszeSMSy.pl, hereinafter referred to as the Service.
1.2 Operator: the entity providing the Service under the LepszeSMSy.pl domain, hereinafter referred to as the Operator.
1.3 User: a natural or legal person who has registered an account and uses the Service.
1.4 Account: an individual User account in the system, identified by an email address and protected by a password.
1.5 SMS: a short text message sent from a SIM card installed in the User's phone via the mobile application.
2.1 Registration requires providing a valid email address, name, and acceptance of these Terms of Service.
2.2 The Service may only be used by persons who are 18 years of age or older, or who have obtained parental consent.
2.3 The User agrees to provide accurate information during registration and to update it when changes occur.
2.4 Each User is entitled to one account. Creating multiple accounts to circumvent limits is prohibited.
3.1 The Service is intended SOLELY for operational communication between the User and their existing customers within an established business relationship. It is NOT a tool for mass marketing, advertising campaigns, or sending offers to people who have not given consent.
3.2 The Service is NOT an SMS gateway, GSM operator, or intermediary in message transmission. The Operator does NOT send messages on the User's behalf, all SMS are sent directly from the SIM card installed in the User's phone via an Android application.
3.3 The User is the sole sender of messages and the controller of recipients' personal data within the meaning of GDPR, the Polish Act on Provision of Electronic Services (UŚUDE), and the Electronic Communications Law (PKE). The Operator acts only as a processor, handles data on the User's instructions.
3.4 Reminders for visits / classes / appointments, information about cancellations or rescheduling, trainer/teacher/doctor changes, access codes and one-time passwords (OTP), order or repair status, booking confirmations, opening hours changes, individual replies to customer inquiries, invoices and payment reminders.
3.5 It is FORBIDDEN to use the Service for: (a) direct marketing without prior, documented recipient consent (PKE art. 398, UŚUDE art. 10); (b) spam, mass advertising campaigns to lists obtained without consent; (c) misleading content, fraud (phishing, smishing); (d) illegal content, infringing personal rights, threats, hate speech; (e) political and electoral communication without required consents; (f) sending to opt-out numbers (User is required to maintain their own opt-out list).
3.6 SMS delivery is carried out via a dedicated Android application installed on the User's phone with an active SIM card.
3.7 Messages are sent from the User's SIM card number. The Operator does not act as an intermediary in SMS transmission.
3.8 The Service enables scheduling future operational sends, grouping contacts, and managing message templates.
3.9 Available features include automated operational reminders, Google Calendar integration, and a statistics dashboard.
4.1 Every new account receives a 7-day free trial with full access to all Service features.
4.2 After the trial period, the User may choose a paid subscription plan available in the pricing section of the Service.
4.3 All prices are listed as net amounts. Applicable VAT must be added in accordance with current tax regulations.
4.4 Right of withdrawal (B2C)
a) Consumers (B2C users) have the right to withdraw from a distance contract within 14 days without giving any reason, pursuant to art. 27 of the Polish Consumer Rights Act. The period starts on the day the contract is concluded.
b) Exception (art. 38 pt. 13 UPK): the right of withdrawal does not apply if the service has been fully performed within 14 days with the explicit and prior consent of the Consumer expressed at purchase. The Consumer is informed before granting such consent.
c) To exercise the right of withdrawal, send a statement to piotrkrych@monolynx.com. You may use the standard withdrawal form (Annex 2 to UPK, link on the website). Refund will be made within 14 days using the same payment method used at purchase.
d) Withdrawal provisions do not apply to business users (B2B), these are governed by individual agreement and the Polish Civil Code.
5.1 The User is the SOLE sender of messages and the controller of recipients' personal data (GDPR art. 4(7)). The User bears full responsibility for: (a) message content and its compliance with law (GDPR, PKE, UŚUDE, Consumer Rights Act); (b) having a legal basis to contact the recipient (contract, legitimate interest, or consent, depending on context); (c) fulfilling information obligations (GDPR art. 13/14) towards recipients; (d) handling data subjects' requests (GDPR art. 15-22) regarding data in their database; (e) maintaining and respecting an opt-out list.
5.2 The Operator LepszeSMSy.pl acts as a PROCESSOR (GDPR art. 28) and is not responsible for the content or manner of use of the Service by the User. In particular, the Operator does not verify whether recipients have consented to receiving messages, this is the User's obligation.
5.3 SMS delivery depends on GSM network conditions, battery level, and internet connectivity of the User's device. The Operator does not guarantee 100% delivery.
5.4 LepszeSMSy.pl makes every effort to keep the Service available 24/7 but does not guarantee uninterrupted access and is not liable for technical interruptions.
5.5 In case of recipient complaint or supervisory authority audit (UODO/UKE) regarding message content or sending, the User releases the Operator from all liability and undertakes to cover any fines, proceedings costs, and damages.
6.1 The User may cancel their subscription at any time from the account dashboard. Access to the Service remains active until the end of the paid period.
6.2 The User may delete their account by sending a request to the Operator's email address. Data will be removed in accordance with the Privacy Policy.
6.3 LepszeSMSy.pl reserves the right to suspend or delete the account of any User who violates these Terms of Service.
7.1 These Terms of Service are governed by Polish law. Matters not covered herein are subject to the Civil Code and the Act on Providing Electronic Services.
7.2 The Operator reserves the right to amend these Terms. Users will be notified of any changes at least 14 days in advance by email.
